The present conditions of sale are concluded one the one hand by KAYDARA Ltd whose headquarters are located at 2nd Floor, 9 Chapel Place, London EC2A 3DQ, United Kingdom, registered in England and Wales under the company number 05684800 Email address: parfumaufildutemps@free.fr Telephone: +44 20 8371 2384 hereinafter referred to as “Vendor” and on the other hand, by any natural or legal person wishing to proceed to a purchase via the website http://aufildutemps.co/ hereinafter referred to as “Buyer”.

1/ Purpose

The present conditions of sale aim to define the contractual relationship between the Vendor and the Buyer and the applicable conditions for any purchase made via the Vendor’s commercial website http://aufildutemps.co whether the Buyer is professional or consumer. The acquisition of a good through the present website by the Buyer automatically entails his acceptance without reserve of these sales conditions. These conditions of sale shall prevail over any other terms or conditions not expressively agreed by the Vendor. The Vendor reserves the right to modify the content of these conditions of sale at any time. In this case, the applicable conditions will be the ones in effect at the date of the order by the Buyer. The present conditions are available to all on the website aufildutemps.co

2/ Characteristics of the available goods

The products sold are those which appear in the catalog published on the Vendor’s website: aufildutemps.co These products are valid only as long as supplies are available. Each product is accompanied by a description established by the Au Fil du Temps. The photographs of the products are the most faithful as possible but cannot ensure a perfect similarity with the product, in particular with regard to the colors.

3/ Prices

The prices that appear on the website aufildutemps.co are after-tax prices in euros and depending on VAT applicable on the day of the order; any change in rate could have repercussions on the price of products or services. The Vendor reserves the right to change prices at any time, on the understanding however that the price listed on the website aufildutemps.co on the day of the order will be the only one to apply to the Buyer. The prices that appear do not include transport and delivery fees.

4/ Delivery

All available products on the website are limited to Metropolitan France, Corsica, Monaco and the countries available for delivery. For non-listed countries, one should address an email directly to: parfumaufildutemps@free.fr The delivery delays are communicated with purely indicative purposes, and without guarantee. A delay of delivery will not be deemed to justify the termination or cancellation of an order, the refusal of goods or rights to damages. Performance of our obligation of delivery shall furthermore be subject to the condition of due and timely fulfillment of the Buyer’s obligations towards the Vendor, in particular payment obligations. Deliveries are made to the address indicated on the order form, which must be within the agreed geographical zone. Responsibility for the purchased goods lies with the buyer from the moment the goods leave the Vendor’s premises. In the event of damages incurred during the transport, the justified protest must be made to the transporter within 3 (three) days from the date of delivery.

5/ Orders

The Buyer wishing to purchase a product or service is obliged to: • Validate the basket of his/her order after having verified it, • Complete the identification form on which he/she will state all the requested details, • Confirm his/her order and payment thereof, • Confirm the payment. Once the Buyer has registered his/her order by clicking on the “Order” icon, this confirmation implies acceptance of the present terms of sale, acknowledgment of perfect understanding of the latter, and renouncement of benefiting from his/her own terms of sale or other terms. All information provided and the registered confirmation is proof of the transaction. The confirmation shall be deemed a signature and acceptance of the operations conducted. Confirmation of the client’s registered order will be automatically sent by email.

6/ Period of withdrawal

The Buyer enjoys the benefit of a 7 (seven) day period of withdrawal from the date of delivery of their order to return the product to the Vendor to exchange it or for a penalty free reimbursement, with the exception of the return costs of expedition.

7/ Terms of payment

Payment is required at the time of ordering. All orders are made exclusively through the online store available at the address aufildutemps.co and are payable • by check (the dispatch is only made once the check has been received and has cleared) to the following address: KAYDARA Ltd 2nd Floor, 9 Chapel Place, London EC2A 3DQ, United Kingdom • by Paypal: After having selected the chosen products available for sale and having clicked on the button “Order” the Buyer will be redirected to the Paypal website so as to proceed with the payment. The Vendor reserves the right to cancel or refuse any order from a customer with whom there is a dispute concerning payment of a previous order. Dispatch will only take place once the Vendor has received payment.

8/ Guarantee

All products supplied by the Vendor are legally guaranteed pursuant to the provisions of articles 1641 et seq. of the French Civil Code. In case of non compliance of a sold product, it can be returned to the vendor who will take it back and exchange or refund it. All complaints, exchange or reimbursement requests must be carried out by post to the following address: KAYDARA Ltd 2nd Floor, 9 Chapel Place, London EC2A 3DQ, United Kingdom within a 30 (thirty) day period after the initial delivery date.

9/Responsibility

The Vendor, in the process of on-line sale, is held only by a best effort undertaking; he cannot be held liable for any damage resulting from using the Internet such as loss of data, intrusion, virus, service interruption, or any other unintended issues. The Buyer is responsible for the information he provides when proceeding with the order payment (in particular the e-mail address and/name and delivery address to which the information will be sent). The Vendor declines all responsibility in case of an incomplete or incorrect electronic and/or physical address and will not be held responsible for the consequences of such an error (product delivery delay or impossibility). The Vendor declines all responsibility in case of a dispute between the Buyer and the Paypal company. The Vendor declines all responsibility in case of non-performance of the purchase order due to force majeure.

10/ Intellectual property

All components from the website are and remain the intellectual and exclusive property of the Vendor. Nobody is allowed to reproduce, exploit, rebroadcast, or use for any reason whatsoever, even partially, any elements of the site.

11/ Personal data

Under the French law of the 6th January 1978 relating to computing, databases and freedoms, nominative personal details concerning the Buyer may be the object of automated treatment. The Vendor reserves the right to collect information on the Buyer, including through the use of cookies. The Buyer can object to the divulgation of his contact details by notifying the Vendor. The users also have a right to access and rectify data concerning them, under the French law of January 6, 1978.

12/ Archiving – Proof

The vendor shall archive the order forms and invoices on a reliable and durable medium providing a true copy in compliance with the provisions of the Article 1348 from the French Civil Code. The Vendor’s computerized registers shall be deemed by the parties to be proof of the communications, orders, payments and transactions having occurred between them.
